This is the first book-length study of the constitution of the state of Kansas. Following the pattern of earlier volumes in Greenwood's State Constitution Series, Professor Heller relates and analyzes the basic law of Kansas, gives the full text of the constitution with an article-by-article and section-by-section commentary, and provides a bibliographical essay and a table of cases, along with a general index. His account of populist and progressive successes (and failures) will be of interest to students, scholars, and any others dealing with the law, politics, and history of this important middle state that has contributed much to the mosaic of our nation's institutions.
Formally, Kansas still operates under a constitution dating from 1959. In fact, however, its present day basic law differs importantly from the original text--and this change was accomplished without resorting to a convention to rewrite the document. This process of incremental revision has never before been described in detail. It resulted, over the span of less than five years, in the streamlining of the executive branch, the creation of a unified judiciary, enhancement of the position of the legislature, and the removal from the constitution of a number of antiquated provisions--more than many other states have been able to do by the convention method.

FRANCIS H. HELLER is the Roy A. Roberts Distinguished Professor Emeritus of Law and Political Science at the University of Kansas. He is the author or editor of fourteen books and numerous articles and book reviews on a broad range of constitutional and political topics.

A Good Modern Kansas Constitution Primer

The first 34 pages covers a history of the Kansas Constitution giving a historical backdrop starting with the Louisiana Purchase of 1803 and moving forward very quickly to the Kansas-Nebraska Act of 1854. At this point, the story of the Constitution actually begins. It mentions the three previous attempts of writing a constitution (Topeka, Lecompton and Leavenworth)before beginning to cover the Wyandotte Constitution of 1859 under which Kansas still operates (albeit in a heavily modified form due to a major revision effort in the 1970s which is also covered in the book). This history as told herein reveals some of the political troubles of the time and it is mentioned which other State constitutions were relied upon in the original draft of the Constitution for Kansas, such as Ohio, Indiana and Illinois. This makes sense since the majority of Kansans at that time came from these States. Different aspects of the Constitution are then discussed.
Then in Part 2, the modern Kansas Constitution (not counting the most recent amendment (the marriage amendment which passed after the book was published) is given. Each Article beginning with the Preamble and Bill of Rights is given. the text of the Constitution is given first and then commentary siting court cases, and other information is given to explain each section. This part covers pages 41 through 143. There are end notes at the end of each of the two parts that give additional historical information as well as references to other sources for further study and information.
I was personally impressed by the book and was glad I purchased it. I definitely learned things I never knew about Kansas where I have lived my entire life. Francis Heller did a good job in my opinion of writing the book. Are there things of Kansas history left out, yes, but it is not meant to be a complete history. If you want to understand the Kansas Constitution as it is today, this is a very good place to start.
Areas where I think it could be improved is to have paralleled the sections from the Lecompton Constitution and the original 1859 Wyandotte Constitutions with the modern version to show the differences between them. (The reason these two would be preferred, in my opinion, rather than the Topeka and Leavenworth ones is because they are the only two seriously considered by the federal government as actual State Constitutions.) The original 1859 Constitution, for example, as with many of the northern abolitionist influenced State constitutions of that time, contained provisions very unfriendly to blacks (free or slave) and did much to prevent their settlement and denied them citizenship in the State. Something that is not addressed in this book as those provisions have long since vanished from the Kansas Constitution and this book follows the modern version rather than the historic version of the text. I think the inclusion of both would have been awesome to see how the constitution had changed from the State's founding to its modern form. This book is very good for knowing the modern Kansas Constitution but would not be great (although it would be somewhat helpful) for a historical reference of earlier Kansas Constitutional history.
